Currently, fundamental changes in the international flow of investments are occurring. Due to these changes as well as failures in a system thought to protect investors, international law on foreign investments is also undergoing important changes, with proposals for a reform of the current system multiplying.

This module covers the key components of international investment law. You will introduced to international investment law from its origins to its current design in a way that will frame our discussion of the subject in a critical manner.

Topics covered in this module include:

  • sources of international investment law
  • main legal obligations that fall on the host State
  • compensation and settlement of disputes
  • interplay between promoting investments and protecting other societal values i.e. human rights, the environment, sustainable development, and just transition

What you will learn

In this module you will:

  • discover fundamental changes in the international flow of investments and in international law on foreign investments
  • discuss the failures of the system meant to protect investors
  • learn the key components of international investment law in a critical manner
  • look at the sources of international investment law
  • look at different cases in the energy and water sector and study the reasons behind the proposals for the reform of international investment law

By the end of this module, you will be able to:

  • demonstrate knowledge of the proposals for the reform of international investment law
  • display the required skills and critical knowledge necessary for a career in international economic law

Assignments / assessment

  • remote online tutor-marked exam (100%)

There will also be a formative (mock) examination given early in the semester. Feedback will be provided on this.

Teaching methods / timetable

This module will be delivered through student-led seminars, based on prior reading, to encourage a high level of engagement.  

You will also receive feedback on your understanding and performance through participation in class discussions.
