Examine the main legal rules that affect our private lives as individuals and in our relationships with others. You will learn the principles of Scottish family law and the law of succession.
Topics examined in detail include
- children’s capacity and rights
- the legal regulation of the relationship between children and parents (and other family members)
- recognition and regulation of adult relationships through the law of marriage, civil partnership, and cohabitation
- the property/financial implications of familial relationships
You will also study the purposes behind family law, changes in law, and the social context in which it operates.
What you will learn
In this module, you will:
- gain knowledge and understanding of the principles of Scottish family law, including succession
- acquire knowledge of and the ability to apply key statute and case law
- gain an understanding of the purposes behind family law, changes in law, and the social context in which it operates
By the end of this module, you will be able to:
- analyse legal principles and their application to factual situations
- critically analyse the law in its social context and the desirability of reform
- understand the importance of respect for individuals and diverse family forms
