This module looks at both dispute resolution (DR) and alternate dispute resolution (ADR) in Scottish legal practice. You will explore the huge variety of areas of law that DR and ADR can cover, e.g. contract and property law. This module also covers client communication and negotiation.
What you will learn
In this module, you will:
learn how best to approach the non-advocacy aspects of dispute resolution
develop your problem-solving and drafting skills
explore the choices of forum for DR and ADR
learn how to carry out an initial fact-finding meeting with a client
consider the psychology behind DR
learn how to research, draft, prepare and present an advice note to a client
learn how to effectively prepare for court action and appearance
explore the use of expert witnesses, instruction of advocates, and correspondence with the opponent's agents
learn how best to prepare for a negotiation meeting and endeavour to settle a dispute
By the end of this module, you will be able to:
work with a dispute resolution team in a Scottish law practise, with consideration of alternative modes of resolution of legal issues between parties
