Certainty or flexibility, what future for European Private International Law dealing with family matters?

"The tension between the need for legal certainty and the desire for individualised solutions is as old as the law itself. This tension is particularly important within private international law instruments dealing with family matters in the EU."

In a rapidly-changing world, it seems that there is a spill-over between the integration of the European society which combined with the citizens’ aspirations for flexible solutions demands the adoption of harmonised and predictable rules.

My research will thus evaluate the role played by those two legal concepts in the evolution of Private International Law instruments dealing with family matters and suggest the way forward for the European rules.
