Private Law of Scotland I module (LW11011)

Private law concerns the legal relationships between individuals and can be divided into the law of persons, the law of property, and the law of obligations.  

This module covers how contractual obligations are incurred, the contents of contractual obligations, and how obligations are terminated.

What you will learn

In this module you will:

• be introduced to "promises" and unjustified enrichment
• learn about the factors that might mean a contract cannot be formed (i.e. capacity, illegality, error, and lack of necessary formalities)
• examine when and how a term might be incorporated into a contract
• look at the validity and effectiveness of a selection of common contractual terms
• learn how a contract might be breached and the consequence for the parties of a breach of contract

By the end of this module, you will be able to:

• describe the formation of contracts
• consider the terms of contract in the context of how terms may be incorporated, the validity, and effectiveness of terms
• describe how a contract may come to an end

Teaching methods / timetable

This module will be delivered through a combination of lectures and tutorials.

Lectures will be used to present information and structure your learning. A certain degree of interaction will be expected from you.

Tutorials will allow for small group work and student discussion.

You will be expected to conduct independent study as well. This is to promote a higher level of engagement in the learning process.
