Taught Masters Degrees: Problems in International Commercial Litigation

This is a first semester module, which is assessed by coursework (50%) and a written examination (50%).
The aim of this course is to provide advanced instruction in several key aspects of private international and procedural law that are of particular relevance to business litigation in a European and International context.
By the end of this course, students should:
- gain an understanding of the practical difficulties facing cross-border litigants, their causes and consequences.
- acquire knowledge of the legal and procedural tools which are used to address these difficulties and assess the success of these tools. In particular, seminars will focus on anti-suit and freezing injunctions, harmonised procedures, provisional and protective measures and issues relating to enforcement and execution.
- appreciate policy considerations which underpin State choices in this area.
