This is a second semester module. The method of assessment is 50% coursework and 50% written examination.
This course aims at offering postgraduate students advanced tuition on core fundamentals of the regulation of international business transactions.
The module is divided into three main chapters looking at the sources of international business transactions law, the regulation of the actors of international commercial law, and the treatment of international commercial disputes through arbitration.
After a critical overview of the various methodological and normative approaches to international business law, the focus of the first part of the course will be on the harmonisation of choice of law in international contract and the various forms of lex mercatoria. The study of the main actors involved in business transactions will be devoted to the emergence, nationality and connecting factors of corporations in international law as well as the treatment of international insolvency. Arbitration will then be considered.
The module will be taught through secondary materials and case studies drawn from a variety sources, although the European approach will be the focal point.
