Taught Masters Degrees: Corporate & Regulatory Crime

This is a second semester module. The method of assessment is 40% coursework and 60% written exam.

This module will examine critically the criminal liability of companies and the structure and use of regulatory offences. The theoretical background to corporate liability will be explored as well as the use of strict liability (liability without fault) in regulatory offences. The use of the criminal law in enforcing regulatory regimes, as well as alternative methods of enforcement, will be considered, as will the personal liability of directors and managers. The issue of “corporate killing”, which has recently attracted a lot of debate, and now legislation, in the UK, will be examined as well as the use of the criminal law in particular regulatory contexts such as health and safety.
