ResearchThis research borders on the challenges that OPEC member countries might face as a result OPEC's production quota restriction, which affects trade and is prohibited under the GATT/WTO, when examined in the light of Article XI of the GATT of 1994.
One of the policy that drives the GATT/WTO in the trade of produces is the globalization and the liberalization of major sector of the national economies e.g energy. Petroleum product being a tradeable good among the oil exporting and oil consumer nations had over the years, raised issues both in the political discuss (competition policy)and in the economic discuss (price setting strategy). Though there has been no case brought against OPEC member countries at the level of the WTO but the presumption is that someday, it might be raise despite several anti trust cases by the US against OPEC and its member states. The question is, what is the possibility that OPEC would survive after the end of this legal battle, if it is indeed raise at WTO level; without raising a choice of a single membership.
