No 7 of 1996 Act has set up the Industry and Trade Competition Commission. The Commission may issue orders (which are then registered with the High Court), but has no power to award damages, in the exercise of its function, in the public interest to prevent and control restrictive practices and monopoly situations and prevent unfair trade practices, for which fines may be imposed and damages recovered in the ordinary Courts. It also regulates, and may be approached to sanction, mergers. Proposed investigations of the Commission are required to be advertised in the Government Gazette and the press. In 1999 the first investigation commenced into the marketing and distribution of cement. |
