Date of Item:

11 November 1999

Topic:

Mining law in Austria

Summary:

With January 1, 1999 the Mineral Resources Act, the so called "Mineralstoffgesetz" (MinroG), entered into force in Austria.  This change of legislation brought about an improved structuring and a required deregulisation in the field of mining which was formerly governed by the Mining Act of 1975 (BergG) and its implementing regulations.

A tragic mining accident in the community of Lassing of 1998 which had shattered the entire country had further intensified the striving for reform.  Relevant European directives regarding environmental pollution (96/82 EEC) or dangerous substances (96/61 EEC) have been implemented along with an improvement of the protection of employees of mining companies and an extension of parties' rights in permit procedures.
